According to the terms of U.S. and international copyright laws, they may not be reproduced in any form, electronic or otherwise, for any purpose, without prior express written permission of Photo Edit, Inc.

Artwork, including photographs, drawings, paintings and illustrations, are all "intellectual property" and, in so being, are protected by the US Federal Copyright laws and the Berne Convention. The intellectual property on our site MAY NOT BE DOWNLOADED except by normal viewing process.

Our intellectual property may not be copied to another computer, transmitted, published, reproduced, stored, manipulated, projected, or altered in any way, including without limitation any digitization or synthesizing of the images, alone or with any other material, by use of computer or other electronic means or any other method or means now or hereafter known, without the written permission of PhotoEdit and payment of an agreed upon fee. Failure to obtain this permission is a violation of the US Federal Copyright laws and the Berne Convention.

The copyright law, like any law, can be difficult for the general public to interpret. We have adopted "The Copyright Commandments," which was written by the Picture Agency Council of America (PACA), to help you understand what you must do before you can use the photos displayed on our site. Ignorance of the law is not a defense to legal liability. Please know your responsibilities when it comes to intellectual property.

THE COPYRIGHT COMMANDMENTS

  1. When it is created, it is copyrighted. That's why we use the copyright notice and you must use it in the credit you provide our photographer when you use his or her photo.
  2. The Photographer, or his/her agent, has the exclusive right to exploit the copyright of each image. That right is for the life of the photographer, plus 75 years.
  3. Permission to use a copyrighted photograph, for any purpose whatsoever, must be obtained in advance, in writing, to avoid possible violations of the federal law on copyright.
  4. Any unauthorized use constitutes an infringement.
  5. Penalties for infringement are monetary and can be severe. In the event that we discover an infringement, we will notify you and invoice you for the industry-standard TRIPLE fee for unauthorized usage. If we have to prosecute you for Copyright Infringement in US Federal Court, you will be subject to a fine for statutory damages as well as responsible for paying all court costs and attorneys' fees.
  6. Combining, altering or scanning photographs, or any part thereof, including electronically, is an exclusive right held by the photographer, and permission to combine or alter should be obtained, in writing, prior to any such changes or uses.
  7. Exceeding the terms of a license has been held to be an infringement. A new license is required prior to additional use.
  8. An artist's rendering of a photograph in another medium is a derivative use of an image and requires the written permission of the copyright owner prior to use.
  9. Re-creating a copyrighted photograph is a derivative use and, therefore, requires the permission of the copyright holder of the original image.
  10. Reference use of a photograph, or any part thereof, requires the permission of the copyright holder.
